Terms of Service for LoveHour App

Welcome to LoveHour, a relationship companion app designed for couples to share scheduled photo and caption updates. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and LoveHour Team ("LoveHour," "we," "us," or "our") regarding your use of the LoveHour mobile application and any related services (collectively, the "App").

By accessing, downloading, installing, or using the LoveHour App, you signify that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms or our Privacy Policy, you must not use or access the App.

1. Acceptance of Terms

1.1. Agreement: By creating an account, sending User Content (as defined below), or otherwise using any part of the App, you represent that you have read, understood, and agree to be bound by these Terms.

1.2. Privacy Policy: Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding your data.

1.3. Changes to Terms: We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the "Effective Date" at the top of these Terms, posting a notice within the App, or sending you an email. Your continued use of the App after such modifications will constitute your acknowledgment of the modified Terms and agreement to abide and be bound by them.

2. Eligibility and User Accounts

2.1. Age Requirement: You must be at least eighteen (18) years of age to use the LoveHour App. By creating an account and using the App, you represent and warrant that you are 18 years of age or older.

2.2. Account Creation: To use the LoveHour App, you must register for an account, providing an email address or other specified registration method. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

2.3. Account Security: You are solely responsible for maintaining the confidentiality of your account credentials (e.g., username, password). You are fully responsible for all activities that occur under your account. You agree to notify LoveHour immediately of any unauthorized use of your account or any other breach of security. LoveHour will not be liable for any loss or damage arising from your failure to comply with this section.

2.4. Single User per Account: Each individual user must maintain their own distinct LoveHour account. LoveHour is designed for two individual accounts to be linked as a couple. You may not share your account credentials with anyone, including your partner.

3. User Content

3.1. Definition: "User Content" refers to any photos, images, captions, text, messages, or other content that you upload, post, share, or transmit through the LoveHour App.

3.2. Ownership of User Content: You retain all ownership rights in and to your User Content. LoveHour does not claim ownership of your User Content.

3.3. License to LoveHour: By submitting User Content through the App, you grant LoveHour a limited, non-exclusive, royalty-free, worldwide, sublicensable license to host, store, display, perform, transmit, and distribute your User Content solely for the purpose of operating, improving, and providing the LoveHour App and its features to you and your connected partner. This license terminates when you delete your User Content or your account, unless your User Content has been shared with others (e.g., your partner) who have not deleted it, or if it is required to be retained by law.

3.4. Your Responsibilities for User Content: You are solely responsible for your User Content, including its legality, reliability, accuracy, and appropriateness. You represent and warrant that:

• You own the User Content or have all necessary rights, licenses, consents, and permissions to use and authorize LoveHour to use your User Content as contemplated by these Terms.
• Your User Content does not infringe upon, misappropriate, or violate the intellectual property rights, privacy rights, publicity rights, or any other rights of any third party.
• Your User Content will not violate any applicable law or regulation.

3.5. Prohibited User Content: You agree not to upload, post, share, or transmit any User Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, pornographic, sexually explicit, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.

3.6. Monitoring and Enforcement: LoveHour reserves the right, but not the obligation, to monitor, review, or remove User Content at our sole discretion, without notice, if we believe it violates these Terms.

4. Acceptable Use Policy

4.1. General Use: You agree to use the LoveHour App only for its intended purpose: to share private, scheduled updates with your designated partner.

4.2. Prohibited Activities: You agree not to use the App for any illegal or unauthorized purpose, engage in harassment, or interfere with the performance of the App.

5. Intellectual Property Rights of LoveHour

5.1. LoveHour IP: The App, its entire contents, features, and functionality are owned by LoveHour and are protected by law.

5.2. Limited License to You: LoveHour grants you a limited, non-exclusive, non-transferable, revocable license to install and use the App for personal use.

6. Privacy Policy

Your use of the App is subject to LoveHour's Privacy Policy. Our Privacy Policy explains how we collect, use, and disclose information that pertains to your privacy.

7. Third-Party Services and Links

The App may contain links to third-party websites or services that are not owned or controlled by LoveHour.

8. Disclaimers

8.1. "AS IS": THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, LOVEHOUR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.

10. Indemnification

You agree to defend, indemnify, and hold harmless LoveHour and its affiliates from and against any claims arising out of your violation of these Terms or your use of the App.

11. Termination

11.1. By LoveHour: We may terminate or suspend your account and access to the App immediately, without prior notice or liability.

11.2. By You: You may terminate your account at any time by following the instructions within the App or by contacting us at romano@rovalapps.com.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

13. Miscellaneous

These Terms, together with the Privacy Policy, constitute the entire agreement between you and LoveHour regarding your use of the App.
